IT HAS BEEN AGREED AND ESTABLISHED AS FOLLOWS:
Article 1. Purpose
This document aims to define and set the general conditions of the seasonal rental.
Article 2. Rented Property
Capacity of the property: The number of persons occupying the property must not exceed the number of sleeping accommodations mentioned. If the number of intended occupants exceeds the initial request, the TENANT commits to seek prior approval from Tahiti Homes, which reserves the right to adjust the rental price if necessary. Any additional person not authorized by Tahiti Homes® and staying in the property without prior agreement will be charged.
The property is rented solely for vacation rental purposes. Any commercial event or party is strictly prohibited. Any unauthorized use of the property will result in the immediate removal of its occupants without the possibility of a refund.
Pets: Pets are only welcomed if their presence has been requested and accepted at the time of booking.
Article 3. Duration of the Rental
The stay may not exceed the number of nights indicated on the attached reservation, except with Tahiti Homes®’ written consent. The total amount of rent remains due to TAHITI HOMES® if the TENANT decides to shorten the duration of the rental.
At the start of the rental, TAHITI HOMES® or its representative will provide the TENANT with the keys and instructions for the accommodation.
The TENANT cannot, under any circumstances, claim a right to remain in the premises after the expiration of the rental period specified in this contract. In the case of an unauthorized extension of the rental duration by more than two (2) hours compared to the check-out date and time mentioned on the reservation, a full night’s charge will be billed to the TENANT.
Arrivals – Departures
Arrival: Check-in is scheduled for 3 PM. With prior agreement, we can authorize check-ins between 8:30 AM and 5 PM free of charge depending on the availability of the rental.
Arrivals outside these hours are possible; however, an additional fee will be requested. Indeed, outside regular check-in hours, a night guide service is set up for the comfort of the tenants.
In the case of an arrival requiring the night guide service, the meeting for the handover will be scheduled with one of our agents the day after your arrival or at another agreed time.
During the check-in appointment, a Tahiti Homes® agent or one of its representatives (or house staff) will meet you at the property. You will tour the property together, and you will sign a document confirming your entry into the property. In case of delay, we ask you to inform us so that we can reorganize. We will send you an itinerary or a meeting point and the number of the person to contact in case of delay. For any guaranteed arrival earlier than 3 PM, an additional night will be charged. In all cases, these requests must be addressed in writing and expressly validated by Tahiti Homes.
Delay: An agent will be waiting to welcome you; in case of a delay at arrival, we ask you to inform us as soon as possible. Any delay of one hour or more will be charged at 84 €.
Departure: The check-out and key handover must be completed before 11 AM. Our representative, following an agreed time (at your arrival), will meet you on-site at the latest by 10:30 AM for an inspection and to collect the keys.
For a guaranteed late departure, an additional night will be charged.
Failure to return the keys at check-out will be subject to prosecution and deductions from the security deposit for damages incurred.
Article 4. Rent
4.1 Amount and Payment of Rent
The agreed rent is the amount mentioned on your reservation.
This rent includes:
Bed linen and towels provided upon arrival Usual consumption of water, gas, and electricity Cleaning of the premises before your arrival Welcome and departure with one of our concierges Assistance during your stay Free Internet access Agency fees
Our prices do not include (unless otherwise indicated) the final cleaning; however, we will handle it on your behalf at your expense. The amount of the final cleaning depends on each property according to its area; please contact us.
If the final cleaning is included in the rental amount, please note that a fee of 200 Euros or 23,866 XPF will be charged in addition if we find during the exit inspection that the state of the property and interiors was in a deplorable state or at least requiring more than reasonable cleaning to return the property to its condition.
Bed linens are provided at the beginning of the stay, and it is the tenant’s responsibility to ensure they are used properly and returned in a decent condition. Any damaged or indelible linen will be charged to the tenants.
Payment of a Deposit
A deposit of THIRTY percent (30%) of the total amount of your rental must be paid at the time of booking + 84 € reservation fee to confirm it. The deposit can be paid in various ways:

In the case of a bank transfer or check, the reservation will be held for 72 hours pending payment. After 72 hours, if payment is not made, the option will cancel, and the availability of the property will no longer be guaranteed.
In the case of a bank transfer, the charges related to the transfer as well as the variation in the exchange rate are the exclusive responsibility of the tenant. The amount received in XPF or Euros must exactly match the amount announced during the reservation.

No keys will be handed over without full payment of the rent.
For any stay occurring less than 30 days from the date of reservation, full payment of the rental will be requested at the time of booking.
For stays of one month or more, special conditions for the payment of rent may be established.
4.2 Reservation Fees:
84 € will be charged for your reservation. This allows us to maintain a high level of service. Our company does not charge you fees for bank movements and management supplements inherent in arrivals or departures on holidays and Sundays.
4.3 Security Deposit
The TENANT owes TAHITI HOMES® a security deposit, by credit card imprint or Polynesian bank check, in addition to the rent. This security deposit is due at the entry into the premises. It will not be debited from the TENANT’s account provided that the exit inspection is satisfactory.
Note that some rentals require the full payment of the security deposit at the time of booking, which will then be fully refunded if the exit inspection conducted by us is satisfactory. Please contact us to know the rentals concerned.
The security deposit is intended to cover any necessary repairs or restorations that might be required following the TENANT’s departure as well as the replacement of missing or damaged items (furniture, linens, any equipment). The security deposit should not be considered as a contribution to the rent payment.
Upon arrival, the person whose name is on the reservation must sign our client arrival form and show a valid credit card as well as their passport. In the case of a security deposit by credit card authorization, this person must present the same credit card for proof of validity or another valid card.
If no damage was noted during the exit inspection (TAHITI HOMES® reserves the right to perform an exit inspection within 15 days after the departure date):

The amount of the restoration will be determined amicably between TAHITI HOMES® and the TENANT. In case of disagreement, a restoration estimate will be made by a professional or other authorized organization chosen by TAHITI HOMES® and independent from it.
4.4 Household Linen
If applicable, if items are missing or damaged, we will debit the following amounts:

Note that we will debit a minimum of 50 € or 5,990 XPF if one or more items are missing or damaged, even if the additional amount is less than 50 €.
Article 5. Obligations of TAHITI HOMES®
TAHITI HOMES® is bound by the following principal obligations:
To deliver to the TENANT the accommodation in good condition for use and repair, as well as the equipment mentioned in the contract in good working order; To ensure that the TENANT has peaceful enjoyment of the accommodation. TAHITI HOMES® cannot be held responsible for defects, hidden defects, or non-compliances by the owner. To maintain the premises in a condition to serve the intended use and to make all necessary repairs.
TAHITI HOMES® is not responsible for personal items left in the property during or after the stay and cannot be held liable for injuries, damages, losses, or expenses directly or indirectly resulting from events beyond our control. TAHITI HOMES® cannot be held responsible for any error, fault, omission, or negligence present on our website.
Article 6. Obligations of the TENANT
The TENANT agrees to occupy the property only for private purposes during their tourist or professional stay. Under no circumstances may it be used for a commercial, craft, or professional activity. The property must be occupied by the contract signer and their companions within the limit of the number of people the property can accommodate.
The TENANT must notify TAHITI HOMES® within 48 hours of their arrival if any of the equipment does not function properly or for any dissatisfaction (e.g., cleanliness of the property). After this period, the TENANT accepts the rental as it was entrusted. Otherwise, the agency will do everything possible to intervene as quickly as possible; however, there are few service providers available on our islands, especially on weekends, holidays, and in the evening. If a malfunction occurs in the fundamental equipment such as plumbing, the electrical system, or appliances, the agency will do its utmost to have the repairs carried out as quickly as possible. Note that any malfunction of washing machines and other appliances will not give rise to any compensation.
The TENANT will take the rented premises in their current state and maintain them in good condition throughout the duration of this contract. They must answer for any damage and losses occurring during the duration of the contract in the premises of which they have exclusive enjoyment, unless they prove that they occurred due to force majeure, by the fault of TAHITI HOMES® or by the act of third parties that they did not introduce into the dwelling.
Any transformation or arrangement will require the express and written consent of the owner. In the absence of this agreement, the agency may require the restoration of the property or equipment at the tenant’s departure, or keep the transformations or arrangements made without the tenant being able to claim compensation for the expenses incurred. The agency may also require, at the tenant’s expense, the immediate restoration of the premises to their condition in the event that the transformations or arrangements jeopardize the proper functioning of the equipment or the safety of the property.
The replacement, repair, or troubleshooting of materials or accessories attached to the rental are the exclusive responsibility of the TENANT if they are responsible for the loss or damage.
All intentional or unintentional damage caused by the tenant during their stay will be billed to them.
The TENANT may not exercise any recourse against TAHITI HOMES® in the event of theft and damage to the rented premises.
TAHITI HOMES® cannot be held responsible for water, gas, or electricity cuts, thefts or damage to personal effects, and nuisances due to the neighborhood.
The TENANT and their companions commit not to commit any act that could harm the tranquility of other residents of the building, neighborhood, subdivision, and generally of their neighbors. The rules of the condominium are applicable to the tenant.
The TENANT also commits not to cause or suffer to be caused any disturbance of enjoyment to the neighborhood. The sound level of music reproduction devices, radio broadcasting stations, and televisions must be adjusted so that the neighbors cannot be disturbed. In any event, all noise, whatever its cause, is prohibited from 10 PM to 7 AM. Do nothing, use no machine or device that may bring to the neighborhood any nuisances by bad smells, uncleanliness, vibrations, tremors, and noise, or in any other way.
The TENANT may under no circumstances use the telephone of the rented property or connect a telephone handset to one of the telephone jacks of the property to make a call. If they use the telephone line, a penalty of 200 € (or 23,866 XPF) will be charged to them.
If the TENANT has not purchased an exit cleaning, or if the cleaning is not included in the rental rate, the TENANT is obligated to return the property in the same state of cleanliness and order as upon their arrival. The property subject to this agreement must be returned in the condition in which it was entrusted to the tenant. Otherwise, a flat rate of 300 € (or 35,800 XPF) for the restoration will be billed to the TENANT.
In all cases, even if the TENANT has purchased an exit cleaning, or if the cleaning is included in the rental rate, they must clean and put away the dishes, and empty the trash bins. Otherwise, a flat rate of 50 € (or 5,970 XPF) for the restoration will be billed to the TENANT.
In the case of a missed appointment with one of our agents or house staff for the check-in or check-out, a flat rate of 84 € will be charged to the tenant.
The TENANT must return the set of keys to one of our agents (or house staff, or at the indicated place) during check-out, if the keys and/or remote controls are missing or lost at the departure of the tenant, their replacement will be billed to the tenant.
Article 7. State of the Premises and Inventory
The state of the premises and the inventory conducted by TAHITI HOMES® alone and given to the TENANT upon their entry into the accommodation will be contestable by the TENANT within 24 hours following their entry into the accommodation. In the absence of contestation by the TENANT within this 24-hour period, the state of the premises and the inventory conducted by TAHITI HOMES® and communicated to the TENANT upon their departure from the premises will be deemed accepted without reservation by the TENANT.
Article 8. Insurance
The TENANT, if they have one, agrees to provide TAHITI HOMES®, at the time of booking, their Civil Liability insurance certificate (covering damages caused by imprudence or negligence).
In the case where the TENANT is not covered by Civil Liability insurance, the Tenant acknowledges and accepts the risks incurred.
The TENANT, not covered, also has the option to subscribe to multi-risk insurance and/or repatriation offered by TAHITI HOMES®.
Article 9. Modification – Cancellation of the Rental:
Modifications to your reservation:
These are modifications made to the arrival or departure date. If the modification occurs 45 days before the scheduled arrival date, no fee will be charged to you. If the modification occurs within 45 days and considering our cancellation policy below, 84 € (or 10,000 XPF) in additional fees will be charged to you.
Cancellation by Tahiti HOMES®:
In the case where unforeseen circumstances (fire – damage – burglary – sale, etc.) would make the property subject to these terms inaccessible, TAHITI HOMES® commits to relocating the client in a property of equivalent category without additional charges, provided that the price of the replacement property is within a range of plus or minus 10% of the value of the initially rented and inaccessible property. Furthermore, TAHITI HOMES® commits to offering, where applicable, properties of a higher category, subject to a price adjustment at the client’s expense. In the event that relocation could not be done, the full amount of sums received by TAHITI HOMES® will be refunded to you. TAHITI HOMES® will in no case be subject to a demand for compensation.
Any cancellation of this contract by TAHITI HOMES® before the entry date must be notified to the TENANT as soon as possible.
Cancellation conditions – Cancellation penalties:
In case of cancellation of this rental contract, the TENANT agrees to notify their decision to TAHITI HOMES® as soon as possible by registered letter with acknowledgment of receipt, it being specified that no cancellation will be taken into account if communicated by telephone. The date of receipt determines the cancellation fees according to the following scale (except in cases of force majeure duly justified).
This scale is not applicable in the many cases of cancellation provided for by the insurance (cancellation, water damage and fire, furniture damage, etc.) that you can subscribe to through our agency, it is optional and its cost is calculated as accurately as possible based on the amount of your rental.
** If your cancellation occurs more than 45 days before your arrival date: refund of the deposit less the 84 € reservation fees that remain due.
** If the cancellation occurs between 45 days and 30 days before the scheduled arrival date, the cancellation fees will be equal to 30% of the amount of your rental (i.e., the amount of the deposit) less the 84 € reservation fees that remain due.
** If the cancellation occurs between 30 days and the scheduled arrival date: the cancellation fees will be equal to 100% of the amount of your rental and ancillary fees and services.
It is specified that in all cases of cancellation, the reservation fees of 84 € remain acquired by the agency TAHITI HOMES®.
Upon receipt of the cancellation, this contract will be deemed terminated by operation of law, and TAHITI HOMES® may dispose of the rented properties.
The above cancellation policy won’t be applicable if reservation has been made under a specific non-refundable rate plan.
Article 10. Termination of the Contract
This contract will be deemed terminated by operation of law, and TAHITI HOMES® may dispose of the rented properties:
in the case where the TENANT does not show up after 5 PM on the scheduled day of entry, and in the absence of notification of arrival delay; in the case where the TENANT does not pay the balance of the rent or the security deposit, at the latest 30 (thirty) days before arrival. in the case of a termination of the contract by the TENANT
Article 11. Flat-Rate Compensation in Case of Legal Proceedings
Any act of legal proceedings will be at the TENANT’s expense.
Article 12. Settlement of Disputes
In the event of a dispute concerning these terms, or any dispute arising from its application, only the courts of French Polynesia will have jurisdiction.
Article 13. Election of Domicile
For the execution of these terms and their consequences, the parties elect domicile at their respective headquarters and residences as indicated above.
